1. Acceptance of Terms
By accessing or using moat.ch ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
The Service is operated by the owner of moat.ch ("we", "us", "our"), based in Zurich, Switzerland. Formal company registration is pending — contact support@moat.ch for the current legal operator details.
2. Description of Service
moat.ch provides a web-based financial data platform for fundamental analysis, including access to financial statements, custom formula creation, stock screening, and watchlist features.
3. Accounts
You must create an account to use the Service. You are responsible for maintaining the security of your account credentials. You must provide accurate information and keep it up to date.
4. Subscriptions and Billing
The Service is offered on a subscription basis with a 7-day free trial.
Payment Processing
All payments for the Service are processed by a third-party payment provider acting as our authorised reseller and Merchant of Record. When you purchase a subscription, your purchase is made through this payment provider, who handles billing, payment processing, invoicing, sales tax, and VAT on our behalf. Your purchase may also be subject to the payment provider's buyer terms and privacy policy.
Free Trial
Payment details are required at signup, but you will not be charged until the 7-day trial period ends. After the trial period, your subscription will automatically convert to a paid subscription unless cancelled. Subscriptions renew automatically unless cancelled before the renewal date.
Cancellation
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You can cancel through your account settings or by contacting us at support@moat.ch.
Refunds
Refunds are handled by our payment provider in accordance with applicable consumer protection laws. Consumers in the EU/EEA, Switzerland, and the UK have a 14-day statutory right of withdrawal. For full details, see our Refund Policy.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to the Service or its systems
- Scrape, crawl, or use automated tools to extract data from the Service
- Resell or redistribute data obtained from the Service
- Interfere with or disrupt the Service or its infrastructure
6. Intellectual Property
The Service, including its design, code, and content, is owned by the operator of moat.ch and protected by applicable intellectual property laws. Financial data is provided under license from third-party data providers.
7. Important Disclaimer — Not Financial Advice
The Service is provided for informational and educational purposes only. No content on moat.ch — including financial data, charts, analysis tools, screeners, formulas, or any other information — constitutes financial, investment, tax, or legal advice.
No recommendation to buy, sell, or hold. Nothing on the Service should be construed as a recommendation, solicitation, or offer to buy, sell, or hold any security, investment product, or other financial instrument. Any reference to a particular security or investment is not a recommendation.
You are solely responsible for your investment decisions. You alone must evaluate the merits and risks of any investment based on your own objectives, financial situation, and needs. moat.ch is not a fiduciary and owes no duty to you regarding the suitability of any investment.
Consult a qualified professional. Before making any investment decision, you should consult with a qualified financial advisor, tax professional, or other licensed professional who can assess your individual circumstances.
Past performance is no guarantee of future results. Historical data, backtested results, or any performance information shown on the Service should not be relied upon as an indicator of future performance.
Data accuracy. Financial data is sourced from third-party providers and may contain errors, omissions, or delays. We make no representations or warranties regarding the accuracy, completeness, reliability, or timeliness of any data. You should independently verify any information before relying on it.
Investment risk. All investments carry risk, including the potential loss of principal. The value of investments can go down as well as up.
Service provided "as-is" and "as-available". The Service and all data provided are offered on an "as-is" and "as-available" basis without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
User-generated formulas and screening criteria. moat.ch provides tools that allow users to create custom formulas and screening criteria. moat.ch is not responsible for the mathematical accuracy or outcomes of user-generated formulas or screening criteria. Any results produced by such user-defined logic are the sole responsibility of the user who created or applied them.
8. Limitation of Liability
To the maximum extent permitted by law, the operator of moat.ch shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of profits, data, or investment losses.
To the maximum extent permitted by law, the total aggregate liability of moat.ch for any claim arising out of or relating to the use of the Service shall be limited to the total amount paid by you to the Service during the six (6) months immediately preceding the event giving rise to the claim. This limitation applies regardless of the form of action, whether in contract, tort, or otherwise.
9. Modifications
We reserve the right to modify these Terms at any time. We will notify you of any material changes at least 30 days before they take effect by email to the address associated with your account and/or by a prominent notice within the Service.
If you do not accept the modified Terms, you may cancel your subscription before the new Terms take effect. Such a cancellation takes effect immediately upon submission and, in any case, no later than the date the modified Terms would otherwise apply to you. If you have prepaid for a subscription period that extends beyond the cancellation date, we will refund the unused portion on a pro-rata basis. All other aspects of cancellation are governed by Section 4 (Subscriptions and Billing). If you continue to use the Service after the new Terms have taken effect, you are deemed to have accepted the modified Terms.
Changes required by applicable law or regulatory authorities may take effect immediately, regardless of the notice period above. We will inform you of such changes as soon as reasonably practicable.
10. Termination
We may suspend or terminate your account at any time for violation of these Terms. Upon termination, your right to use the Service ceases immediately.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of Switzerland. Any disputes shall be resolved in the courts of Zurich, Switzerland.
